New Jersey’s traffic laws and regulations are contained in Title 39 of the state’s statutes. You’ll find regulations on speeding, drunk or impaired driving, reckless driving, and other rules of the road. Those laws help law enforcement officials sort out which motorist was in the right or wrong when the inevitable New Jersey traffic accident occurs. If you’ve been in a New Jersey car accident, you’ll soon find yourself dealing with the state’s complex insurance regulations. The type of insurance you have has a direct impact on the type of claim you can file – and many people don’t realize this when they are making choices about their policies. When you purchase automobile insurance you limit the type of injuries for which you can sue (also called your tort threshold), you can choose no threshold or limitation on lawsuit threshold — even if you are not at fault for the accident. If you chose the limitation on lawsuit threshold, your insurance premium may be lower, but if you are not seriously hurt in a car crash, you may not be able to file a claim for your pain and suffering. If you choose limitation on lawsuit threshold, you can sue for all injuries as long as you have at least one permanent injury. Usually, a herniated disc is sufficient to exceed the threshold.
There are many exceptions to these rules. For example, you may be able to sue for pain and suffering in cases involving permanent injuries and death – even if you did elect to limit your tort threshold. However, not all attorneys understand how to properly handle these cases and you need an experienced personal injury lawyer to make sure your rights to compensation are pursued. It is important to know that cases involving a commercial vehicle, such as a truck or bus, are zero threshold cases, meaning you can sue for both permanent and non-permanent injuries.
New Jersey’s accident laws are also complex when it comes to car accident claims. Unlike many states, New Jersey has no fault insurance, which means that if you have been injured in a car accident, you must file a claim with your own insurance company – even if the accident was someone else’s fault. Your own car policy only covers expenses up to the amount of personal injury protection (PIP) coverage you have elected. If your medical or other expenses associated with the accident exceed your PIP coverage, you may need to file a claim against the auto insurer for the other driver.
New Jersey accident law mandates that any accident claim must be filed within the New Jersey statute of limitations, which is two years of the injury, with very limited exceptions.
