Woman Severely Injured after Slip and Fall on Snow and Ice – $300,000 Settlement

A 63-year-old woman was attempting to cross a property’s parking lot on Fair Lawn Ave in Fair Lawn, New Jersey to reach her car when she slipped on ice and fell. Davis, Saperstein & Salomon, P.C. Partner Garry R. Salomon filed suit in the Superior Court of New Jersey, Bergen County, proved the negligence of the property managers and landscaping company in failing to clear ice/snow hazards and won the client a $300,000 settlement.

The client injured her back, shoulder, and hip during her fall, and was diagnosed with superior acetabular labra tear and partial tears in her right hip, a fracture, bone marrow, and soft tissue edemas in her pelvis, linear undersurface tearing, and diffuse rotator cuff tendinosis in her right shoulder, lumbar spine disc herniations and nerve impingements, and aggravation of cervical disc disease and spondylosis. To treat her hip, she underwent right hip arthroscopy, chondroplasty, femoroplasty, and psoas tendon release. For her shoulder, she received a Kenalog injection and underwent right shoulder arthroscopy, arthroscopic subacromial decompression, and arthroscopic debridement of a partial thickness rotator cuff tear. For her back pain, she received a steroid injection. The client also underwent courses of physical therapy to improve her pain.

Davis, Saperstein & Salomon, P.C. hired medical experts to author narrative reports proving the permanent nature of the client’s injuries and the aggravation of several preexisting conditions. Partner Garry Salomon also hired an engineering expert to prove that the property managers and landscaping were responsible for the client’s fall due to their failure to follow the proper procedure to remove snow and ice hazards. The experts’ reports helped Davis, Saperstein & Salomon, P.C. Partner Garry Salomon prove that our client deserves financial compensation for her pain & suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances, and available insurance coverage.
