A 63-year-old man injured his back on the job while lifting boxes at his workplace in East Hanover, New Jersey. Davis, Saperstein & Salomon, P.C. Partner Steven Cohen, Chairman of the firm’s workers compensation department, filed a claim in the State of New Jersey Department of Labor, Workers Compensation Division, proving that the client deserves compensation for his injury, and won him a $266,898.70.

The injured worker went to St. Barnabas Medical Center in Livingston, New Jersey due to his severe back pain where he was diagnosed with lumbar polyradiculopathy, spinal stenosis, disc bulges, disc herniation, and lumbar strain.

Davis, Saperstein & Salomon, P.C. retained medical experts to author narrative reports proving the permanent nature of the client’s injuries and inability to return to work. The experts’ reports helped Partner Steven Cohen win the client compensation for his pain & suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
