Over $1 Billion in Verdicts and Settlements

Restaurant Manager Rear-Ended by Pickup Truck – $512,500 Settlement

A restaurant manager was rear-ended by a pickup truck while stopped in traffic in Teaneck, New Jersey. The manager hired Davis, Saperstein & Salomon, P.C. Partner, and attorney Paul A. Garfield to represent him in his lawsuit against the careless driver. After Paul A. Garfield proved that the truck driver had been negligent in his failure to drive carefully, our client won a $512,500 settlement.

The injured manager dropped his son off at Teaneck High School and continued driving south on Queen Anne Road. While stopped a truck rear-ended him. The truck driver claimed that sun glare had affected his vision and he was unable to see our client. Our client was taken by ambulance to the Holy Name Medical Center in Teaneck, New Jersey.

The collision injured his neck and back, causing two disc herniations and three-disc bulges throughout his cervical and lumbar spine. He also developed temporomandibular joint disorder (TMJ). The client first tried conservative treatment, including chiropractic treatment and physical therapy. He then underwent lumbar epidural injections and one cervical epidural injection to his neck, however he may need future neck surgery.

The firm hired medical doctors to serve as expert witnesses and to author narrative reports proving the permanent nature of these injuries. Their reports helped prove that our client’s pain and suffering medical bills and loss of income justified a significant financial settlement.

Davis, Saperstein & Salomon, P.C. Partner Paul A. Garfield sued the driver in the Superior Court of New Jersey, Bergen County, and proved that he had been driving negligently. He won our client proper compensation in the form of a $512,000 out-of-court settlement.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances, and available insurance coverage.
