Patti LaBelle Lawsuit Settlement Proceeds to Children’s Charity

Teaneck, New Jersey (Vocus / PRWEB) November 30, 2012 – New Jersey personal injury lawyer Samuel L. Davis and his law firm recently donated the entire proceeds from the $100,000 settlement of a lawsuit his clients filed against singer Patti LaBelle a year ago.

Davis is a partner with the New Jersey personal injury firm of Davis, Saperstein & Salomon, P.C., which features offices throughout New Jersey and in New York City. He joined clients Kevin and Roseanna Monk of New York on October 18, 2012, in presenting the $100,000 check to Columbia University Medical Center’s Hope and Heroes Children’s Cancer Fund.

The donation was part of a settlement the Monks reached with LaBelle in October in exchange for the dismissal of a lawsuit that they had filed against her in November 2011 in the Supreme Court of New York over an alleged hostile encounter the singer had with Roseanna Monk in front of her then-18-month-old daughter in November 2010.

“Roseanna, who is a former kindergarten teacher, and her husband, Kevin, saw this donation as an opportunity for Ms. LaBelle to help a lot of children,” Davis said. “They feel very pleased that they were able to make this donation to a very worthy cause.”

Hope & Heroes helps children with cancer and their families by funding the Herbert Irving Child & Adolescent Oncology Center at Columbia University Medical Center, which is one of the largest and most distinguished pediatric oncology programs in the U.S.

The donation ends a case that, according to the complaint, started with a November 11, 2010, encounter in a Manhattan apartment building.

Roseanna Monk told the New York Post that she had been confronted by LaBelle, a Grammy-winning singer who was staying in New York to perform in a Broadway show, while Monks was getting ready to leave on a family trip.

As she headed out to meet her husband at the car, Monk had temporarily placed her toddler daughter, Genevieve, by the door, Monk said. According to the Post, LaBelle saw the child and “angrily admonished” Monk, who was pregnant at the time.

The November 2011 complaint alleged that LaBelle committed “intentional acts” during the incident that included yelling, screaming obscenities, throwing water and drenching with water, attempting to strike and physically injure Monks, physical harassment and the intentional infliction of emotional distress.

As a result, Genevieve suffered fear, emotional distress, personality changes, sleep disorder, increased fear of strangers and other permanent injuries, the lawsuit alleged.

LaBelle denied liability.

In December 2011, the case was removed to the U.S. District Court for the Southern District of New York, which issued an order dismissing the lawsuit on October 17, 2012 following the settlement. (11 CIV 9258).
