Driver Was Rear-Ended At A Traffic Light – $734,000 Settlement

One morning, a driver was stopped at a traffic light on Passaic Avenue at the intersection of Eagle Rock Avenue in Roseland, NJ. While waiting for the light to turn green, the driver behind him became distracted and rear-ended his vehicle. The impact was significant enough to push his car forward by 2–4 feet, triggering a chain reaction and causing his vehicle to collide with the car in front of him.

At the scene, the man reported back pain to emergency responders but chose not to go to the hospital immediately. However, on his way home, he was disoriented and even blacked out. He went to an urgent care facility, where he was prescribed ibuprofen and discharged.

Over the following days, he suffered dizziness, imbalance, nausea, neck and back pain, as well as ringing in his left ear. His family also noticed some cognitive changes, like short-term memory loss and increased irritability. After seeking further medical help, he underwent an MRI, which revealed multiple annular tears and disc herniations in his neck and lower back.

Due to the severity of his injuries, he was recommended for anterior cervical discectomy, a surgery that removes the damaged intervertebral disc from the spine through the neck, and fusion neck surgery at C5-6 and C6-7, with the placement of titanium interbody cages. Despite the surgery, he will need ongoing physical therapy and possibly even additional surgery to manage his pain.
