Over $1 Billion in Verdicts and Settlements

Tractor-Trailer Truck Driver Injured on I-287 by Rear-End Collision- $300,000

A 45-year-old tractor-trailer driver suffered severe injuries to his head and knees after being rear-ended by a car southbound on I-287 in Morris Township, New Jersey. The driver of the car made an unsafe lane change and struck the rear of the tractor-trailer, causing it to hit a guardrail and tree off the road. Davis, Saperstein & Salomon, P.C Partner Steven Benvenisti filed suit in the Superior Court of New Jersey, Morris County, proving that the car driver was negligent in failing to operate his vehicle safely, and won the client a $300,000 settlement.

The injured client was taken by ambulance to Morristown Medical Center in Morristown, New Jersey, and was diagnosed with meniscus tears and chondromalacia on both knees, a laceration on his left leg, and post-concussive syndrome. The crash also resulted in an aggravation of the man’s preexisting arthritis in both knees. After his laceration was treated, he underwent two additional surgeries to remove a blood clot and mass from his thigh, as well as reconstructive surgery of the left lower extremity. To improve his pain and PTSD, our client completed several courses of physical and cognitive therapy.

Davis, Saperstein & Salomon, P.C. hired medical experts to author narratives proving the permanent nature of the client’s injuries. The experts’ reports helped Partner Steven Benvenisti win the client compensation for his pain & suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
