Over $1 Billion in Verdicts and Settlements

Woman Injured After Highway Water Tank Collision- $775,000

A woman was driving on Interstate 287 in Hanover, New Jersey when a water tank fell off a pick-up truck and collided with the front of her car. Davis, Saperstein & Salomon, P.C. Partner Adam Lederman filed suit in the Superior Court of New Jersey, Morris County, proved the pick-up truck driver was negligent in failing to properly fasten the water tank, and won our client a $775,000 settlement.

The State Police ticketed the truck driver with wrongfully allowing a spill on the roadway. The woman suffered injuries to her head, cervical spine and lumbar spine, and was taken by ambulance to Morristown Medical Center in Morristown, New Jersey. Her diagnosis included mild post-traumatic brain injury, post-traumatic concussion, occipital neuritis, cervical spine disc herniations, and lumbar spine facet joint syndrome. These head injuries resulted in issues with memory, speech, visuomotor functioning, and attention. As part of her treatment, she received conservative pain medications and attended regular physical therapy and speech therapy sessions.

Davis, Saperstein & Salomon, P.C. retained medical experts to author narrative reports proving the permanent nature of the client’s condition. These experts also determined that injuries sustained in the accident aggravated her preexisting degenerative spinal condition. Additionally, Partner Adam Lederman hired a vocational economics expert to assess the woman’s future employability and earning capacity. The expert found that the woman’s injuries caused work-limitations, resulting in a significant loss in future earning capacity of several hundred thousand dollars. The experts’ reported helped Davis, Saperstein & Salomon, P.C. Partner Adam B. Lederman win the client a settlement for her medical bills, loss in income, and pain and suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
