Main Street, Woodstown, New Jersey

A 44-year-old woman suffered severe injuries after slipping and falling on a wet floor at a nail salon on Main Street in Woodstown, New Jersey. The firm client was wearing foam disposable pedicure slippers, and had just stood up from the manicure table when she fell. Davis, Saperstein & Salomon, P.C Partner Patricia Z. Boguslawski filed suit in the Superior Court of New Jersey, Salem County, proving that the salon was negligent in failing to safely maintain their premises to avoid hazards, and won the client a $525,000 settlement.

The firm client injured her hip during her fall and was diagnosed with a femoral neck fracture of the left hip. For treatment, she underwent left total hip arthroplasty and completed several courses of physical therapy to improve her condition. Davis, Saperstein & Salomon, P.C. Partner Patricia Z. Boguslawski won our client a settlement for her injuries, pain & suffering.

Settlements are often limited by the total available insurance coverage. Insurance company adjusters and their lawyers often defend cases by claiming that a client was negligent and could have avoided being injured by arguing comparative negligence on the part of an injured client; or that their pain and suffering was caused by pre-existing medical conditions or prior injuries. Despite those defenses, the Davis, Saperstein & Salomon, PC lawyers won their client’s injury claim. Each client’s case is unique. Results may differ because of different facts, circumstances and available insurance coverage.
